INTRODUCTION AND ACCEPTANCE

1.1 Company Information

These Terms and Conditions (“Terms”) govern the use of the Drivergill mobile application (“App” or “Platform”) operated by SUGAM SURAKSHA SARTHI INDIA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at Company Address].

1.2 Acceptance of Terms

By downloading,  installing,  accessing,  or using the Drivergill App,  you (“User”,  “Customer”,”Passenger”) acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, please do not use the App.

1.3 Age and Legal Capacity

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services. By using the App, you represent and warrant that you meet these requirements.

DEFINITIONS

  • “App” or “Platform”  means the Drivergill mobile application and all related services.
  • “Company”, “We”, “Us”, “Our”  means SUGAM SURAKSHA SARTHI INDIA PRIVATE LIMITED.
  • “User”, “Customer”, “Passenger”, “You”  means any person who accesses or uses the App.
  • “Driver” or “Service Provider” means independent third-party drivers who provide transportation services through the Platform.
  • “Services” means the technology platform connecting passengers with drivers for transportation services.
  • “Booking”, “Trip”, “Ride”  means a transportation service request made through the App.
  • “Transaction”  means any financial transaction processed through the App.

NATURE OF SERVICES

3.1 Technology Platform

Drivergill is a technology platform that connects passengers with independent drivers. We do not provide transportation services directly but facilitate connections between users and drivers. 

3.2 Independent Contractors

All drivers are independent contractors, not employees of the Company. The Company does not control how drivers provide transportation services and is not responsible for their actions or omissions.

3.3 Commission Model

The Company operates on a commission-based model, earning a percentage of the fare for facilitating the connection between passengers and drivers

USER REGISTRATION AND ACCOUNT

4.1 Registration Requirements

To use certain features of the App, you must create an account by providing accurate and complete information including your name, phone number, email address, and other required details.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4.3 Verification

We may require verification of your identity, phone number, or other information before allowing you to use certain features of the App.

BOOKING AND SERVICE TERMS

5.1 Booking Process

5.2 Service Availability

Services are subject to driver availability and may not be available in all areas at all times. We make reasonable efforts to connect you with drivers but do not guarantee availability.

5.3 Geographic and Time Limitations

  • Services may be limited to certain geographic areas and time periods as determined by the Company and local regulations.

PAYMENT TERMS

6.1 Payment Methods

  • The App accepts various payment methods including credit/debit cards, digital wallets, UPI, and cash (where available). All electronic payments are processed in compliance with RBI guidelines.

6.2 Pricing Structure

  • Fare calculations are based on factors including distance,  time,  demand,  and local regulations.Surge pricing may apply during peak demand periods or night as per applicable guidelines.

6.3 Commission Structure

  • The Company retains a commission from each completed trip. Drivers receive the majority of the fare as per applicable regulations.

6.4 Payment Security

  • All payment processing complies with PCI DSS standards and RBI guidelines for digital payment security.

CANCELLATION AND MODIFICATIONS

7.1 User Cancellation Rights

  • You may cancel a booking before or after a driver assignment. Cancellation fees may apply as per the Cancellation and Refund Policy.

7.2 Driver Cancellation

  • Drivers may cancel bookings for valid reasons. In case of driver cancellation without valid reason, compensation may be provided as per local regulations.

7.3 Maharashtra Guidelines Compliance

  • In Maharashtra, cancellation penalties follow the state’s Aggregator Cab Policy 2025, including compensation to passengers for driver cancellations without valid reason.

DRIVER REQUIREMENTS AND TERMS

8.1 Driver Eligibility

  • Drivers must meet minimum requirements including valid driving license, permits, and background verification.

8.2 Vehicle Standards

  • All vehicles must meet safety and quality standards as specified by local transportation authorities.

8.3 Conduct Standards

  • Drivers must maintain professional conduct, follow traffic rules, and provide safe transportation services.

SAFETY AND SECURITY

9.1 Safety Features

  • The App includes GPS tracking, driver verification, emergency contact features, and incident reporting mechanisms

  • In case of emergencies,  users can access emergency contacts and report incidents through the App.

9.3 Data Security

  • We implement appropriate technical and organizational measures to protect user data in compliance with applicable data protection laws.

PROHIBITED USES

           Users must not:

  • Use the App for unlawful activities
  • Harass,  abuse,  or harm drivers or other users
  • Attempt to circumvent payment systems
  • Violate intellectual property rights
  • Provide false information
  • Use the App in any manner that could damage or impair the service
 

INTELLECTUAL PROPERTY

11.1 App Ownership

The App, including all content, features, and technology, is owned by the Company and protected by intellectual property laws.

11.2 Limited License

You are granted a limited,  non-exclusive license to use the App for its intended purpose.

DISCLAIMERS AND LIMITATIONS

12.1 Service Availability

The Company does not guarantee uninterrupted or error-free service availability.

12.2 Third-Party Services

We are not responsible for the quality, safety, or legality of services provided by drivers or other third parties.

12.3 Limitation of Liability

To the maximum extent permitted by law, the Company’s liability is limited to the amount paid for the specific service giving rise to the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

DISPUTE RESOLUTION

14.1 Grievance Mechanism

We maintain an internal grievance redressal mechanism. Complaints can be submitted through the App or customer support channels.

14.2 Consumer Rights

These Terms do not limit your rights under the Consumer Protection Act, 2019, or other applicable consumer protection laws.

14.3 Jurisdiction

These Terms are governed by Indian law. Disputes are subject to the jurisdiction of courts in Company’s registered city i.e, Delhi.

TERMINATION

The Company may terminate or suspend your access to the App immediately, with or without notice, for any breach of these Terms or for any other reason.

GOVERNING LAW AND COMPLIANCE

These Terms are governed by and construed in accordance with:

  • Indian laws
  • Reserve Bank of India guidelines
  • Consumer Protection Act,  2019
  • Motor Vehicle Act and related regulations
  • Digital Personal Data Protection Act,  2023
  • Information Technology Act,  2000
 

AMENDMENTS

The Company reserves the right to modify these Terms at any time. Changes will be posted in the App and take effect immediately upon posting. Continued use constitutes acceptance of modified Terms.
