These Terms and Conditions (“Terms”) govern the use of the Drivergill mobile application (“App” or “Platform”) operated by SUGAM SURAKSHA SARTHI INDIA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at Company Address].
By downloading, installing, accessing, or using the Drivergill App, you (“User”, “Customer”,”Passenger”) acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, please do not use the App.
You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services. By using the App, you represent and warrant that you meet these requirements.
Drivergill is a technology platform that connects passengers with independent drivers. We do not provide transportation services directly but facilitate connections between users and drivers.
All drivers are independent contractors, not employees of the Company. The Company does not control how drivers provide transportation services and is not responsible for their actions or omissions.
The Company operates on a commission-based model, earning a percentage of the fare for facilitating the connection between passengers and drivers
To use certain features of the App, you must create an account by providing accurate and complete information including your name, phone number, email address, and other required details.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Services are subject to driver availability and may not be available in all areas at all times. We make reasonable efforts to connect you with drivers but do not guarantee availability.
The App accepts various payment methods including credit/debit cards, digital wallets, UPI, and cash (where available). All electronic payments are processed in compliance with RBI guidelines.
Fare calculations are based on factors including distance, time, demand, and local regulations.Surge pricing may apply during peak demand periods or night as per applicable guidelines.
The Company retains a commission from each completed trip. Drivers receive the majority of the fare as per applicable regulations.
All payment processing complies with PCI DSS standards and RBI guidelines for digital payment security.
You may cancel a booking before or after a driver assignment. Cancellation fees may apply as per the Cancellation and Refund Policy.
Drivers may cancel bookings for valid reasons. In case of driver cancellation without valid reason, compensation may be provided as per local regulations.
In Maharashtra, cancellation penalties follow the state’s Aggregator Cab Policy 2025, including compensation to passengers for driver cancellations without valid reason.
Drivers must meet minimum requirements including valid driving license, permits, and background verification.
All vehicles must meet safety and quality standards as specified by local transportation authorities.
Drivers must maintain professional conduct, follow traffic rules, and provide safe transportation services.
The App includes GPS tracking, driver verification, emergency contact features, and incident reporting mechanisms
In case of emergencies, users can access emergency contacts and report incidents through the App.
We implement appropriate technical and organizational measures to protect user data in compliance with applicable data protection laws.

You are granted a limited, non-exclusive license to use the App for its intended purpose.
The Company does not guarantee uninterrupted or error-free service availability.

To the maximum extent permitted by law, the Company’s liability is limited to the amount paid for the specific service giving rise to the claim.
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
We maintain an internal grievance redressal mechanism. Complaints can be submitted through the App or customer support channels.
These Terms do not limit your rights under the Consumer Protection Act, 2019, or other applicable consumer protection laws.
These Terms are governed by Indian law. Disputes are subject to the jurisdiction of courts in Company’s registered city i.e, Delhi.
The Company may terminate or suspend your access to the App immediately, with or without notice, for any breach of these Terms or for any other reason.
